Tutor Privacy & Data Processing Addendum

1. Scope & Role of the Parties

This Tutor Privacy & Data Processing Addendum ("Tutor Addendum") supplements the Xpeak AI Terms of Service and Privacy Policy and applies only to users registered as tutors on the Xpeak AI platform.

If there is any conflict, this Tutor Addendum controls only with respect to tutor-specific data processing.

For purposes of applicable data protection laws:

• Xpeak Lab Inc. is the data controller
• Tutors act as independent service providers
• Tutors are not employees of Xpeak Lab Inc.

This Addendum applies to all tutor-related data processed in connection with:

• Tutor onboarding
• Tutor profiles
• Lessons
• Payments
• Performance analytics
• Platform safety and quality systems

2. Tutor Data We Collect

In addition to data described in the Privacy Policy, we may process the following tutor-specific data:

A. Identity & Verification

• Legal name
• Profile photo
• Country of residence
• Government-issued identification (where required)
• Identity verification results (via third-party providers)

B. Professional & Profile Information

• Teaching languages and qualifications
• Education and certifications
• Teaching experience
• Availability and scheduling preferences
• Tutor bio, introduction videos, and profile content

C. Lesson & Performance Data

• Lesson attendance and completion
• Lesson recordings and transcripts (where applicable)
• Student feedback and ratings
• Tutor responsiveness and reliability metrics

D. Financial & Tax Information

• Payout account details
• Earnings history
• Tax documentation required by law

E. Platform Usage & Analytics

• Login and activity data
• Interaction with platform features
• Communication metadata (not message content unless required)

3. How We Use Tutor Data

Tutor data is processed for the following purposes:

• Enabling tutor onboarding and account management
• Connecting tutors with students
• Scheduling and delivering lessons
• Processing payments and payouts
• Verifying identity and preventing fraud
• Ensuring platform quality, safety, and trust
• Providing tutor performance insights and analytics
• Improving matching, recommendations, and platform features
• Complying with legal, tax, and regulatory obligations

4. AI, Analytics & Profiling (Important Section)

Xpeak AI uses automated systems and AI-assisted analytics to:

• Recommend tutors to students
• Rank or sort tutors in search or discovery
• Identify quality, reliability, and engagement signals
• Detect potential fraud or policy violations
• Improve learning outcomes and platform efficiency

These systems do not make employment decisions and do not produce legal effects outside the platform.

Where required by law, tutors may:

• Request clarification about data used in profiling
• Object to certain processing
• Request human review of specific decisions

5. Lesson Recordings & Tutor Content

Tutors acknowledge that:

• Lessons may be recorded
• Recordings may be used for:
  • Quality assurance
  • Safety and dispute resolution
  • Tutor development
  • AI-powered learning features

Tutors grant Xpeak AI a limited, non-exclusive license to use lesson recordings and derived data solely for platform-related purposes.

6. Data Sharing

Tutor data may be shared with:

• Students (limited to tutor profile and lesson context)
• Payment and payout providers
• Identity verification providers
• Cloud, analytics, and infrastructure providers
• Legal or regulatory authorities where required

We do not sell tutor personal data.

7. Data Retention

Tutor data is retained:

• While the tutor account is active
• As required to meet legal, tax, or safety obligations
• For a reasonable period after account deactivation

Some data (e.g., financial records) may be retained longer where legally required.

8. Tutor Rights

Tutors have the rights described in the Privacy Policy, including:
